Stillwater Wellness Studio PLLC (“Stillwater Wellness Studio,” “we,” “us,” or “our”) is a Utah Professional Limited Liability Company providing licensed clinical counseling and IASIS Micro Current Neurofeedback services in St. George, Utah. We respect your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit stillwater-wellness-studio.mystagingwebsite.com (the “Site”), contact us by phone or SMS text message at (435) 275-9780, or otherwise interact with us as a prospective client, visitor, or member of the public.
How this policy relates to HIPAA and clinical records
This Privacy Policy governs information you share with us through the Site or as an initial inquiry (for example, when you text or call us at (435) 275-9780). It generally does not cover Protected Health Information (“PHI”) that you share with us in the course of clinical treatment.
- Once you become a client, information you share with your clinician about your health, diagnosis, or treatment is treated as PHI under the federal Health Insurance Portability and Accountability Act (HIPAA), 45 CFR Parts 160 and 164, and is governed by our separate Notice of Privacy Practices (NPP), which we will provide to you before services begin.
- Please do not include sensitive health details, diagnoses, or clinical history in an initial text or voicemail. General statements about the type of support you are seeking are fine; specific clinical information is best shared after we have established a treatment relationship and provided you our NPP.
- Any protected substance use disorder (“SUD”) treatment information is additionally governed by 42 CFR Part 2 where applicable, and will not be re-disclosed without written consent except as permitted by law.
1. Information we collect
We collect the following categories of personal information:
- Contact information you provide when you text or call us at (435) 275-9780: your phone number, the content of your message or voicemail, and any name or contact details you share.
- SMS conversation history: messages you send us and our replies, along with the date, time, and, for opt-in tracking, a record that you initiated contact by texting us.
- Basic technical information from the Site: IP address, browser user agent, and page-view timestamps, used for security and abuse prevention. The Site itself does not currently include a web form and does not collect a name, email, or phone number from visitors.
We do not knowingly collect personal information from children under 13. Utah law generally requires parental or guardian consent for the mental-health treatment of minors under 18, and we address consent requirements individually with each prospective client and their guardian at intake.
2. How we use your information
We use the information you provide to:
- Respond to your inquiry and communicate with you about our services;
- Schedule appointments and send appointment reminders and related informational messages by SMS, in reply to your original text;
- Maintain records of the fact that you contacted us first by text (a permissible opt-in method under carrier and TCR guidance), including the date, time, and originating phone number;
- Protect the security and integrity of our systems and prevent abuse;
- Comply with our legal, regulatory, and professional obligations, including those applicable to licensed clinical social workers and mental-health professionals in the State of Utah.
3. SMS messaging program
Our SMS program is customer-initiated. You opt in by voluntarily texting us at (435) 275-9780. When you text us first, you agree to receive SMS text messages from Stillwater Wellness Studio PLLC in reply.
- Message types: SMS messages are informational only — replies to your inquiry, appointment scheduling, and appointment reminders (conversations, external). We do not send marketing or promotional SMS messages.
- Message frequency: Messaging frequency varies based on your interaction with us.
- Cost: Message and data rates may apply, depending on your mobile carrier and plan.
- Opting out: Reply STOP to any message from us to opt out. You will receive a confirmation and no further SMS messages will be sent, other than a final unsubscribe confirmation.
- Help: Reply HELP to any message, visit https://www.stillwaterwellnessstudio.com, or email help@stillwaterwellnessstudio.com for assistance.
- Consent is not required to receive services. You can call our office or visit in person without agreeing to receive SMS messages.

4. Who we share information with
We share personal information only in the following limited ways:
- Service providers. We use vetted third-party service providers to operate the Site, host our data, and deliver SMS and voice communications (for example, our telephony provider, RingCentral). These providers may process your information only on our behalf and under contractual confidentiality and security obligations. Where a provider handles PHI, we execute a HIPAA-compliant Business Associate Agreement (BAA) with them before doing so.
- Legal requirements. We may disclose information if required to do so by law, subpoena, court order, or other governmental request, or to protect the rights, safety, or property of Stillwater Wellness Studio, our clients, or the public.
- Health and safety. Consistent with Utah Code §78B-3-502 and applicable ethical standards, a licensed mental-health therapist may disclose otherwise confidential information when necessary to prevent a serious and imminent threat of harm to an identifiable victim or to the client. Utah’s mandatory reporting laws (including reports of suspected child abuse under Utah Code Title 80, Chapter 2, and vulnerable-adult abuse under Utah Code §26B-6-201 et seq.) also require disclosures to appropriate authorities.
- Business transfers. If Stillwater Wellness Studio is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to this Privacy Policy or an equivalent successor policy.
SMS consent is not shared with third parties or affiliates. Mobile information (including phone numbers used to contact us and any records of your opt-in) will not be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors that support the SMS program (for example, the messaging platform we use to deliver texts) is permitted; all other use-case categories exclude such text-messaging originator opt-in data and consent — this information will not be shared with any third parties.
5. Confidentiality of clinical services
Communications between a client and a licensed clinical social worker or other licensed mental-health therapist are confidential and protected by Utah law, including Utah Code §58-60-114 (confidentiality obligations of mental-health therapists), the Utah Mental Health Professional Practice Act (Utah Code §26B-8-501 et seq.), and applicable rules of professional conduct. Confidentiality is subject to limited exceptions required or permitted by law, such as those described above.
6. Cookies and tracking
The Site uses only strictly necessary cookies WordPress requires to render pages. We do not use advertising cookies, cross-site tracking pixels, or third-party analytics that profile you across other websites.
7. Data retention
We retain SMS conversations and consent records for as long as necessary to respond to your inquiry, deliver requested services, and satisfy our legal, tax, and professional recordkeeping obligations, and as required by our messaging providers for compliance audits. Clinical records are retained for the period required by Utah law and applicable professional standards. You may ask us to delete records of your inquiry at any time (see Section 9).
8. Security
We use administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. For PHI, we implement the safeguards required by the HIPAA Security Rule (45 CFR Part 164, Subpart C). No system is perfectly secure, however, and we cannot guarantee absolute security of information transmitted to or from us.
9. Your rights and choices
- Access, correction, deletion. You may request access to, correction of, or deletion of the personal information we hold about you by contacting us at help@stillwaterwellnessstudio.com. Requests involving PHI are handled under the process described in our Notice of Privacy Practices.
- Withdraw SMS consent. Reply STOP to any SMS message from us, or email us, to withdraw SMS consent at any time.
- Utah residents. The Utah Consumer Privacy Act (Utah Code §13-61-101 et seq.) provides certain rights regarding personal data for Utah consumers when the controller meets statutory thresholds. Even where those thresholds do not apply to us, we honor reasonable requests to access, correct, or delete personal information collected through the Site or by SMS, subject to legal recordkeeping obligations.
10. Third-party links
The Site may link to third-party websites (for example, mapping services). We are not responsible for the privacy practices of those sites. Please review the privacy policies of any third-party site you visit.
11. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of the page. Material changes will be highlighted on the Site.
